A New York federal judge determined Thursday that Hermès International can proceed with a lawsuit charging that a digital artist infringed on its trademarks by selling “MetaBirkins” nonfungible tokens.
In a one-page order, Judge Jed S. Rakoff of the United States District Court for the Southern District of New York refused the defendant’s motion to dismiss and stated that the court would issue an opinion explaining its decision.
